I'm guessing that Chris Morris/Charlie Brooker's calculation is that, while Banksy would be within his rights to sue, doing so would damage the anti-establishment outlaw credibility that differentiates him from the various Damien Hirsts and Tracey Eminems of the contemporary British art scene.
